HB2892 Summary

• Prohibits reimbursement for prescriptions filled and dispensed outside licensed pharmacies unless no licensed pharmacy exists within 5 miles of the prescribing physician's practice.

• When no licensed pharmacy exists within 5 miles, limits reimbursement to prescriptions with supplies lasting no longer than 72 hours from date of injury or 24 hours from first referral to medical provider, whichever is greater.

• Exempts prescriptions from these limitations when a pre-arranged agreement exists between the medical provider and a preferred provider program regarding out-of-pharmacy filling.

• Maintains existing fee schedule provisions requiring prescriptions filled outside pharmacies to not exceed Average Wholesale Price (AWP) plus a $4.18 dispensing fee.
