HB3037 Summary

• Amends Illinois Vehicle Code to expand ignition interlock device requirements for driving under the influence (DUI) offenses committed on or after January 1, 2017.

• Requires Secretary of State to mandate ignition interlock devices for at least 5 years on all vehicles owned by persons convicted of a second or subsequent DUI offense, including out-of-state offenses and reckless homicide involving alcohol or drugs, if issued a restricted driving permit.

• For offenses committed before January 1, 2017, maintains existing requirement of ignition interlock devices for at least 5 years on all vehicles owned by persons convicted of second or subsequent DUI offenses under state law or local ordinance.

• Allows persons to operate employer-owned vehicles for employment purposes without interlock devices after one year of revocation or one year of restricted permit requiring interlock use, except for multiple DUI convictions within 5 years.

• Persons required to use ignition interlock devices must pay up to $30 per month to the Secretary of State DUI Administration Fund, with Secretary establishing procedures and regulations for device certification and use.
