HB3110 - Social Services Contract Notice Act

• Requires State agencies to provide 30 days prior written notice before terminating, suspending, or reducing contracts with non-governmental social service providers, except in cases of material misrepresentation, breach of contract, or health and safety jeopardy.

• Mandates State agencies notify the Governor and four legislative leaders at least 45 days in advance when suspending, terminating, or reducing social service contracts due to insufficient appropriations or funding reductions, including the amount of appropriations needed to prevent such action.

• Applies to all contracts with non-governmental entities delivering health, safety, education, or welfare services on behalf of the State, regardless of funding source, but excludes goods procurement and contracts between governmental entities.

• Exempts adjustments resulting from GAAP reconciliation, the Illinois Grant Funds Recovery Act, or provider underutilization of contract value from notice requirements.

• Prohibits waiver of the Act's requirements by mutual agreement between parties.
