HB3209 Summary: Competitive Bidding of Local Roads, Streets, and Bridges Act

• Creates the Competitive Bidding of Local Roads, Streets, and Bridges Act to prohibit local government units from entering contracts or intergovernmental agreements that circumvent statutory competitive bidding requirements for road, street, and bridge maintenance and construction.

• Applies to all maintenance and construction work on local roads, streets, and bridges, including bituminous materials, seal coats, and other road materials.

• Permits local governments to maintain and construct roads using their own workers and resources, jointly bid with federal or state agencies, and enter federally-funded projects if application of this act would jeopardize federal funding.

• Limits home rule powers by establishing this act as a constitutional limitation on concurrent home rule authority under Article VII, Section 6(i) of the Illinois Constitution.

• Amends the Intergovernmental Cooperation Act to prohibit intergovernmental agreements that violate competitive bidding requirements, with agreements entered after the act's effective date rendered unenforceable if in violation.
