• Increases administrative fees imposed on employers ordered by the Department of Labor or court to pay wages, from $250/$500/$1,000 to $500/$1,000/$2,000 depending on the amount owed.

• Creates tiered fee structure: $500 for wages owed of $3,000 or less; $1,000 for wages owed between $3,000 and $10,000; and $2,000 for wages owed of $10,000 or more.

• Establishes the Wage Theft Enforcement Fund to receive administrative fees and civil penalties recovered under the Act, with funds used only for enforcement purposes.

• Imposes additional penalties on employers who fail to comply within 15 calendar days of demand or 35 days of court/administrative order: 20% penalty to Department of Labor and 1% per calendar day penalty to the employee.

• Adds Section (b-5) allowing the Department to assess and recover penalties through civil action or administrative proceeding, with representation by the Attorney General.
