HB3400 Summary

• Establishes billing time limits for water utilities: 12 months for residential customers and 24 months for non-residential customers after service provision, effective upon enactment of the 100th General Assembly.

• Applies to municipalities operating waterworks or combined waterworks and sewerage systems, public water districts, water service districts, water authorities, and water commissions.

• Exempts previously billed amounts or amounts for which customers were notified before January 1, 2016, and allows unlimited billing for service loss due to tampering, theft, fraud, or meter-reading prevention.

• Requires utilities to label makeup billing for previously unbilled service with service period dates, calculate charges on a prorated basis if rates varied, and offer payment plans without interest or late fees over a period matching the billing delay.

• Prohibits utilities from intentionally delaying billing beyond normal billing cycles.
