HB3415 Summary

• Requires every employer to verify employment eligibility of newly hired employees through the E-Verify program after the effective date of this amendment.

• Mandates employers receiving economic development incentives (grants, loans, or performance-based incentives) from government entities to register with and participate in E-Verify, and provide proof of compliance before receiving funds.

• Requires the Department of Labor to request a quarterly list of E-Verify registered employers from the U.S. Department of Homeland Security and make it available on the Department's website.

• Establishes E-Verify usage requirements including employee training completion, posting of DHS and anti-discrimination notices, and prohibits use to screen job applicants before hiring or before Form I-9 completion.

• Authorizes the State, political subdivisions, and local government units (including home rule units) to require employers to use an Employment Eligibility Verification System as a condition of receiving a government contract or business license, with noncompliant employers required to repay received incentives within 30 days.
