HB3528 Summary

• Increases Real Estate Administration and Disciplinary Board from 9 to 15 members, with 12 broker members (2 must be pre-license instructors) and 3 public members representing consumer interests; limits board service to 12 years cumulative.

• Replaces terminology of "pre-license schools" and "continuing education schools" with unified "education providers" throughout the Act and establishes comprehensive licensing requirements for education providers offering pre-license, post-license, or continuing education courses.

• Eliminates the Real Estate Education Advisory Council and transfers its duties to the Board, which now recommends education standards, policies, instructor qualifications, and curriculum requirements to the Department.

• Establishes specific course delivery requirements for continuing education including minimum instruction time of 100 minutes per 2-hour course, classroom or live interactive webinar format for core curriculum, and polling questions for webinar participants at least every 30 minutes.

• Adds new ground for discipline (section 20-20(a)(44)) prohibiting brokers from permitting leasing agents to engage in activities requiring a broker's or managing broker's license; effective January 1, 2018.
