HB3703 - Out-of-State Person Subject to Involuntary Admission on an Inpatient Basis Mental Health Treatment Act

• Creates a 2-year pilot project (by January 1, 2018) allowing mental health facilities in Rock Island County, Illinois to accept involuntary inpatient admissions from Iowa residents in the Eastern Iowa Mental Health Region (Cedar, Clinton, Jackson, Muscatine, and Scott counties).

• Iowa courts retain jurisdiction over committed patients while they receive treatment in Illinois, and patients must be returned to Iowa upon discharge or if transferred to state-operated facilities.

• Court orders from either state are recognized and not subject to legal challenge in the receiving state; persons in the pilot project continue under legal custody of their sending state and cannot be transferred or furloughed without sending state approval except in emergencies.

• Receiving agency must arrange re-examinations, extensions, recommitments, and transportation; must pursue and report escapees; and must seek reimbursement from insurance, county, or the sending state.

• Receiving agency must report to the Department of Human Services by August 1, 2019 with demographic data, costs, and outcomes; the pilot project is repealed on January 1, 2020.
