Elected municipal officials are excluded from the Illinois Municipal Retirement Fund (IMRF) unless they meet three conditions: (1) they elect in writing to participate; (2) their municipality adopts a resolution certifying the position requires at least 600 hours of work annually (or 1,000 hours if the municipality has adopted a higher threshold); and (3) they submit monthly time sheets documenting official government business.

Municipalities must file the resolution certifying hourly expectations with the Fund within 90 days after each general election where municipal officials are elected.

Elected municipal officials who fail to submit required time sheets or do not meet the applicable annual hours (600 or 1,000) are prohibited from continuing participation in the Fund.

For officials already holding office when this Act takes effect, the new requirements do not apply to their current term until 90 days after the effective date.

Time sheets documenting work hours must be submitted monthly to the municipal fiscal officer and retained for 5 years; the Fund may request municipalities certify an official's continued eligibility to participate.
