IL HB3739

Creates the Safeguarding Sanctuary Cities Act to protect local governments that limit or restrict compliance with federal immigration detainers.

Defines "detainer" as any order or request from the Secretary of Homeland Security to temporarily hold a person, transport them to federal custody, or notify the federal government prior to their release.

Prohibits the state from reducing or withholding state grant funds to any local government unit that has policies limiting compliance with immigration detainers.

Notes that immigration detainers lack the warrant requirement and probable cause standard required for criminal detainers, and have been erroneously issued against U.S. citizens and non-deportable immigrants.
