HB3764 Summary

• Modifies Workers' Compensation Act benefit rates effective July 1, 2017, reducing maximum weekly compensation in death and permanent total disability cases from 133-1/3% to 100% of the State's average weekly wage.

• Establishes a minimum weekly compensation rate for permanent total disability cases beginning July 1, 2017, set at the lesser of the State's average weekly wage or the employee's average weekly wage.

• Changes the cap on dependent spouse and child benefit increases from unlimited to 83 1/3% of average weekly wage (rather than full average weekly wage).

• Reduces scheduled injury compensation periods for specific body parts (thumb, fingers, toes, hand, arm, foot, leg, eye) occurring on or after the Act's effective date, reverting to or restoring prior benefit levels.

• Reduces total death benefit compensation cap from $500,000 to $400,000 and payment duration from 25 years to 20 years for compensable injuries.
