IL HB3819

Creates the Microphone-Enabled Devices Act to regulate private entities' use of microphones in digital devices including smartphones, tablets, televisions, computers, cars, toys, and home appliances.

Requires private entities to provide written notice to users and obtain informed written consent before enabling a device's microphone, including disclosure of frequency of use, duration, specific categories of information collected, and purpose of collection.

Provides users with a private right of action for violations, allowing recovery of liquidated damages of $5,000 or actual damages (whichever is greater), reasonable attorney's fees and costs, and injunctive relief.

Voids any waiver of the Act's provisions and any agreement that does not comply with its requirements; exempts contractors, subcontractors, and agents working for State agencies or units of local government.

Takes effect immediately upon becoming law.
