• Requires a condemning authority acquiring property for railroad passenger transportation to prove by preponderance of evidence that acquisition is necessary for a public purpose and that a recorded instrument will ensure the property remains consistent with railroad use for at least 40 years.

• Requires execution and recording of the enforcement instrument as a mandatory requirement in any final condemnation order.
