IL HB4282

Amends the Illinois Municipal Code to add a seventh requirement for municipal territory disconnection: land cannot be disconnected if it is designated as part of a redevelopment project area or subject to tax increment financing by the municipality.

The new requirement (Item 7) applies retroactively to petitions and actions that were pending on the effective date of this act as well as those commenced on or after that date.

Maintains six existing requirements for disconnection: the land must contain 20+ acres, be located on the municipal border, not isolate other municipal territory, not disrupt growth plans or zoning, not substantially disrupt municipal services, and not unduly harm the municipality through tax revenue loss.

Preserves the existing procedure requiring property owners to file a petition in circuit court with the municipality as defendant, where the court determines if disconnection requirements are satisfied.

Continues the one-year restriction prohibiting subdivision of disconnected land unless the land has been incorporated into another municipality.
