IL HB4390

Creates new criminal offense of "first responder endangerment" as a Class 4 felony in the Criminal Code of 2012.

Applies to persons with management or operational control of commercial property who knowingly create a dangerous condition and intentionally conceal it, resulting in death or serious bodily injury to a first responder performing official duties.

Defines "dangerous condition" as a life-threatening condition resulting from unpermitted structural work or from building code violations that the person received notice of and failed to correct within specified timeframes.

Excludes from liability actions taken without a permit to address immediate safety threats, governmental entities failing to fund capital improvements, and service providers without overall building management control.
