HB4729 Summary

• Modifies Illinois Vehicle Code Section 4-103 to change the mental state requirement for receiving or possessing stolen vehicles from "knowing" to "knowing or recklessly disregarding" that the vehicle or part has been stolen or converted.

• Allows a trier of fact to infer knowledge or reckless disregard if a person operates a vehicle without owner consent or exercises unexplained possession over a vehicle or essential part.

• Adds subsection (a-1) creating an exception for vehicle repair professionals who knowingly possess manufacturer identification number plates for the purpose of reaffixing them to the same damaged vehicle, subject to Secretary of State notification and record-keeping requirements.

• Requires vehicle owners whose vehicles are repaired under the repair exception to contact the Illinois State Police Vehicle Inspection Bureau within 90 days to arrange an inspection.

• Maintains that violations constitute a Class 2 felony offense.
