HB4747 - Digital Fair Repair Act

• Original equipment manufacturers must make diagnostic and repair documentation available to independent repair providers and equipment owners on the same terms and timeframe as authorized repair providers receive them.

• Manufacturers must offer parts (including embedded software updates) and diagnostic repair tools for purchase by owners and independent repair providers at fair and reasonable terms with equivalent capabilities available to authorized providers.

• Independent repair providers must notify equipment owners in writing before service that repairs by non-authorized providers may affect warranty coverage, that only branded parts cannot be required to maintain warranty, and that the Magnuson-Moss Warranty Act governs warranties.

• The Attorney General may seek injunctions and civil penalties of up to $500 per violation, and must establish a public outreach program to inform consumers and repair providers of their rights under the Act.

• Motor vehicle manufacturers and dealers are excluded from the Act; the law takes effect January 1, 2019.
