• Amends the Consumer Fraud and Deceptive Business Practices Act to protect consumers who purchase wireless phones with service contracts in Illinois.

• If a wireless phone requires repair or replacement 3 or more times during the contract period, the consumer may cancel the service contract without early termination fees or penalties, or elect to upgrade/downgrade the phone.

• When upgrading, consumers pay only the difference between current and new phone prices at best promotional rate; when downgrading, consumers receive a credit for the difference without contract renewal or extension.

• Wireless service providers must provide written disclosure of consumer rights under this law at the point of sale.

• Violations constitute unlawful practices; law does not apply to consumer-caused damage (water damage, physical impact, broken casing) or service quality issues, compatibility problems, or contractual rate disputes.
