HB4886 - Access to Basic Mental Health Information Act

• Allows parents, adult siblings, adult children, spouses, and adult grandchildren to request and receive specified mental health information about a recipient at a mental health facility if they declare involvement in the recipient's care or payment for care.

• Mental health facilities must provide authorized individuals with information including: location, physical and mental condition, diagnosis, treatment needs, services provided, medications needed, discharge planning, and relevant physician reports.

• Information sharing requires either: express recipient agreement, recipient non-objection when given opportunity, physician determination that sharing is in recipient's best interest if unconscious or incapacitated, or physician inference that recipient intends to share the information.

• Mental health facilities must accept relevant information from family and friends about the recipient's history and treatment needs; information provided under confidentiality may be withheld from recipient requests if disclosure would reveal the source.

• Information provided under this Act cannot be used in legal proceedings to the individual's advantage except to prove involuntary admission or need for adult guardianship; facilities are not liable unless information was released deliberately or with gross negligence.
