HB4900 - Illinois Generic Drug Pricing Fairness Act

• Prohibits manufacturers and wholesale drug distributors from engaging in price gouging on essential off-patent or generic drugs that have lost exclusive marketing rights and are manufactured by 3 or fewer U.S. companies.

• Defines price gouging as wholesale acquisition cost increases of 30% or more within one year, 50% or more within three years, or 75% or more within five years, unless justified by increased production costs or expanded access initiatives.

• Authorizes the Director of Healthcare and Family Services and Director of Central Management Services to notify the Attorney General of price gouging violations in the Medical Assistance Program and State health plans.

• Empowers the Attorney General to issue subpoenas, request cost statements, and petition circuit courts for injunctions, restitution, drug availability orders for up to one year at pre-violation prices, and civil penalties up to $10,000 per violation.

• Protects financial information submitted to the Attorney General from public disclosure under the Freedom of Information Act, except when disclosed to support legal proceedings deemed in the public interest.

• Takes effect January 1, 2019.
