Court shall order sealing and impoundment of eviction case files when the court does not find that a tenant or occupant materially breached the lease.

Sealed eviction records shall remain impounded until further court order upon good cause shown, and the petitioner's name shall be obliterated from the official court index.

No filing fee may be collected by the circuit court clerk for petitions to seal eviction court files under this provision.

Court may discretionarily seal eviction files if it finds the plaintiff's action lacks sufficient basis in fact or law and sealing is in the interests of justice.

Court files must be placed under seal for evictions brought under specific tenant protection statutes or when required to be sealed under the mandatory sealing provision.
