• Establishes two-phase procurement process for design-build contracts (qualifications phase followed by proposals phase) and two-phase Construction Manager/General Contractor contracts (preconstruction services phase followed by construction phase), with option for single-phase procurement for projects under $5,000,000.

• Allows proposers to submit Alternative Technical Concepts that deviate from technical requirements if equal to or better than requirements; permits confidential meetings between Transportation Agencies and proposers to discuss concepts before proposal submission.

• Requires design-builder and Construction Manager/General Contractor projects to comply with minority, disadvantaged, and women-owned business utilization requirements and prevailing wage laws; provides Transportation Agencies authority to use eminent domain for property acquisition.

• Makes conforming amendments to multiple state statutes including the Department of Transportation Law, Illinois Finance Authority Act, Illinois Procurement Code, Public Construction Bond Act, Employment of Illinois Workers on Public Works Act, Business Enterprise Act, Toll Highway Act, Eminent Domain Act, and Prevailing Wage Act to implement the new procurement authority.
