HB5113 Summary

• Beginning January 1, 2019, employers must notify the Workers' Compensation Commission, the injured employee, and the employer's insurer within 7 calendar days (excluding Sundays and holidays) of any work injury resulting in loss of 3 or more calendar days of work.

• Employers must submit injury notices electronically on a Commission-prescribed form containing the employer's business information, employee demographics, injury date and circumstances, and other required details.

• Employers who violate the notice requirement 3 or more times in any year face a $100 penalty per violation, with each failure to pay within 30 days constituting a separate violation.

• Upon receipt of an injury notice, the Commission must mail the injured worker information on how to access the handbook describing employee and employer rights and obligations.

• The Commission must compile and publish aggregate injury statistics on its website without identifying individual injured workers or employers, compiled from the notices filed under this requirement.
