HB5206 Summary

• Expands the Department of Transportation's authority to provide intercity railroad passenger service throughout the United States and allows agreements with any state, state agency, local government, or private entity.

• Adds new power to lease or contract locomotives, passenger railcars, and rolling stock equipment to any state agency, public or private entity, or quasi-public entities.

• Permits the Department to establish escrow accounts for maintenance funds and lease/rental payments, with remaining balances deposited into a newly created High-Speed Rail Rolling Stock Fund after escrow terms end (not to exceed 20 years).

• Creates the High-Speed Rail Rolling Stock Fund as a special fund in the State Treasury to be used for purposes related to locomotives, passenger railcars, and other rolling stock equipment.

• Maintains existing restrictions that the Department cannot exercise eminent domain or directly operate railroad service with its own employees, and clarifies that commuter rail service funds cannot be used to subsidize intercity rail operations.
