HB5446 - Crash Report Confidentiality Act

• Creates the Crash Report Confidentiality Act prohibiting public bodies from disclosing crash reports except to specific authorized persons and entities.

• Authorizes disclosure to involved individuals or parties, persons with written permission from involved parties, educational institutions conducting studies, insurance companies, reporters, and news media.

• Applies the confidentiality requirements to all crash report requests, including those made under the Freedom of Information Act.

• Requires the Department of State Police to adopt rules implementing the Act and establishing verification procedures to confirm requesters are entitled to disclosure.

• Provides liability protection for law enforcement agencies acting in good faith compliance with the Act and adds corresponding exemption to the Freedom of Information Act (5 ILCS 140/7.5).
