Expands custodial sexual misconduct crime to include law enforcement employees who engage in sexual conduct or penetration with persons in their custody or under arrest.

Maintains Class 3 felony classification for all custodial sexual misconduct convictions, with mandatory employment forfeiture from law enforcement agencies, penal systems, treatment facilities, or conditional release programs.

Establishes that consent is not a defense and persons in custody are deemed incapable of consenting, including those detained or arrested by law enforcement.

Defines "law enforcement agency" as state or local government agencies charged with law enforcement or management of detained persons, excluding State's Attorneys.

Adds "aftercare specialist" employed by Department of Juvenile Justice and expands "custody" definition to include persons detained or under arrest by law enforcement agencies.
