IL HB5635

Prohibits operating a motor vehicle on a roadway while using an electronic communication device, defined as hand-held wireless phones, personal digital assistants, or portable computers (excluding integrated GPS/navigation systems).

Creates new offense of "aggravated use" when a violation causes a motor vehicle accident resulting in great bodily harm, permanent disability, disfigurement, or death to another person, with the violation being a proximate cause of the injury or death.

Establishes escalating fines for violations: $75 maximum for first offense, $100 for second, $125 for third, and $150 for fourth or subsequent offenses.

Imposes $500 fine for specifically recording the scene of a vehicular accident with an electronic communication device while driving.

Provides 10 exemptions including emergency personnel, emergency reporting, hands-free/voice-operated devices, commercial vehicle displays (10x10 inches max), parked vehicles, stopped traffic with transmission in neutral/park, two-way radios, and single-button voice activation.
