Governor may designate a private not-for-profit corporation to administer a state plan protecting and advocating rights of persons with developmental disabilities under federal law.

Designated agency must be independent from any agency providing treatment, services, guardianship, or habilitation to persons with developmental disabilities.

Agency gains access to developmental disability facilities, mental health facilities, nursing homes, and community-integrated living arrangements to meet residents, distribute information, conduct visits, and inspect records.

Designated agency must submit annual reports to the Department of Human Services including number of facility visits, which facilities were visited, and the nature of each visit.

Persons who in good faith file complaints or provide information to the agency receive immunity from civil, criminal, or other liability and protection from retaliation.
