SB0070 - Network Adequacy and Transparency Act

• Creates the Network Adequacy and Transparency Act requiring health insurers and administrators to file network plans with the Department of Insurance for pre-market review and approval, including policies for provider selection, access standards, and 24/7 availability of primary care and emergency services.

• Establishes minimum provider-to-beneficiary ratios by specialty (including primary care, pediatrics, cardiology, oncology, behavioral health, and 24 other specialties) and maximum travel/distance standards for beneficiaries, to be set annually by the Department based on federal Medicare guidance.

• Requires network plans to post current, accurate provider directories online accessible to the public without login, update directories within 10 business days of changes, and conduct monthly audits of at least 25% of directory listings.

• Mandates 60-day notice to providers and beneficiaries before provider terminations, allows beneficiaries to continue care with departing providers for up to 90 days during ongoing treatment, and permits beneficiaries whose providers leave the network to change plans outside open enrollment within 60 days.

• Grants the Department of Insurance authority to conduct quarterly compliance audits, issue cease and desist orders, and impose fines on insurers or administrators violating the Act's provisions; takes effect January 1, 2018.
