SB0722 - Full and Fair Noneconomic Damages Act

• Prohibits juries from considering defendant's wrongdoing, misconduct, guilt, wealth, or financial resources when determining noneconomic damages (pain and suffering awards).

• Requires bifurcated trials in cases involving punitive damages if requested by any defendant, with the first stage determining compensatory damages and the second stage determining punitive liability.

• Requires trial courts to perform rigorous post-trial review of noneconomic damage awards and consider factors including whether evidence inflamed passion or prejudice, improperly considered defendant's wealth or misconduct, or exceeded comparable verdicts.

• Provides appellate courts with de novo (independent) review standard when considering challenges to noneconomic damage awards as excessive.

• Applies only to actions filed on or after the bill's effective date and takes effect immediately upon becoming law.
