SB1347 - Living Wage Act

• Establishes a minimum wage of $16.36 per hour for workers employed by Illinois state contractors and subcontractors on new contracts issued on or after January 1, 2018.

• Requires annual adjustments to the minimum wage based on the Consumer Price Index for Urban Wage Earners and Clerical Workers (Midwest Region), rounded to the nearest 10 cents, with the Department of Labor publishing rates at least 90 days before they take effect.

• Applies to all state contracts including procurement, construction, services, leases, and concessions contracts, and requires contractors to include wage provisions in all subcontracts at any tier.

• Provides workers a private right of action to recover unpaid wages plus attorney's fees, with contractors and subcontractors liable for 20% penalties to the Department of Labor on first violations and 50% on subsequent violations within 5 years.

• Establishes debarment provisions prohibiting contractors found in violation twice within 5 years from bidding on state contracts for 4 years, with automatic 4-year debarment for criminal convictions under the Act.
