Environmental Protection Agency must propose rules within 6 months of the effective date, and the Board must adopt rules within one year, allowing subdivision of permitted clean construction or demolition debris sites for phased closure of subdivided areas before full site closure.

Rules must include standards for site subdivision and subdivided area closure, including application formats, final cover material requirements, erosion control, recordkeeping, inspection procedures, owner certification of compliance, Agency response timelines, and permit modifications.

Until Board rules take effect, the Agency may grant interim permit modifications for subdivided area closure within permitted debris fill operations if the modifications protect human health and the environment.

Agency must consult with mining, construction, and real estate development industry members during rule development to promote the purposes of subdivision and phased closure provisions.
