SB1383 Summary

• Amends the Illinois Underground Utility Facilities Damage Prevention Act to expand definitions and requirements for excavators and facility operators conducting excavation or demolition work.

• Requires excavators to pre-mark work areas, provide 48 hours to 14 calendar days advance notice through a One-Call Notice System, and use hand excavation or vacuum excavation within tolerance zones around marked utilities.

• Establishes new notice requirements for damaged, dislocated, and exposed underground utility facilities, including specific information that must be provided to facility owners and the One-Call Notice System.

• Imposes penalties up to $5,000 for excavators who fail to provide notice and up to $2,500 for other violations; establishes penalties up to $5,000 for facility operators who fail to mark or respond to locate requests within required timeframes.

• Makes certain provisions apply to home rule municipalities with populations over 1,000,000 and creates an Illinois Underground Utility Facilities Damage Prevention Fund from collected penalties to support safety programs through JULIE.
