IL SB1449

Allows property owners in unincorporated township road districts to transfer title of private residential roadways and easements to the township road district with approval from the township board of trustees and the highway commissioner.

Requires a binding written agreement between the property owner(s) and township road district that may include provisions for allocating initial construction or repair costs at the time of transfer.

Transfers the responsibility for maintenance, repair, and servicing of the roadway to the township road district upon the effective date of transfer and after initial costs are paid.

Exempts transferred roadways from standard township road district rules and specifications regarding location, width, grades, surface, and drainage structures that existed on the transfer date.

Applies only to counties with populations of at least 500,000 (per most recent U.S. Census), roadways fully within township boundaries, and roadways not part of gated communities or restricted access areas.
