Small Wireless Facilities Deployment Act Summary

• Establishes statewide standards for local government regulation of small wireless facility deployment on utility poles and wireless support structures to ensure fair and predictable processes for wireless providers.

• Classifies small wireless facilities as permitted uses subject to administrative review rather than zoning approval when collocated in rights-of-way or on commercial/industrial property; limits authority restrictions on facility placement, height (10 feet above pole), and horizontal separation.

• Sets application processing timelines of 90 days for existing structures and 120 days for new utility pole installations, with automatic approval if authorities fail to act within deadlines; caps application fees at $650 for single facilities and $350 per facility for multiple applications.

• Limits annual collocation rates on authority utility poles to $200 per year or actual direct costs, whichever is less; requires nondiscriminatory rates and standardized make-ready work procedures for pole modifications.

• Does not apply to municipalities with populations of 1,000,000 or more; excludes private property, park/forest/conservation districts, and rail carriers without consent; repeals June 1, 2021.
