SB1501 Summary

• Exempts the Illinois State Guard from the Illinois Administrative Procedure Act's definition of "agency."

• Expands the State Employee Indemnification Act to include Illinois State Guard members serving on State active duty and the Illinois State Guard as a state entity.

• Establishes the Illinois State Guard as a non-federally recognized military force composed of Unorganized Militia members aged 18-45 and others determined necessary by the Governor, activated by Governor proclamation when the Illinois National Guard is unavailable.

• Adds mental competency standards to the Illinois Code of Military Justice requiring court-martial proceedings to follow federal military rules regarding fitness to stand trial and determination of mental responsibility.

• Repeals all 82 prior sections of the State Guard Act and replaces them with new provisions governing organization, personnel, pay, discipline, equipment, uniforms, and regulations for the State Guard.
