Employers may file workers' compensation safety programs and return to work programs with the Illinois Workers' Compensation Commission for certification as bona fide programs.

Safety programs must include adequate employee safety training, joint employer-employee safety committees, use of safety devices, and consultation with safety organizations.

Return to work programs must include light duty or restricted duty work options, leave of absence policies, and full duty return to work policies.

The Director of Insurance must direct rate-setting advisory organizations to recalculate workers' compensation premiums within 90 days to account for certified employers' safety and return to work programs.

The Director of Insurance must waive the Workers' Compensation Commission Operations Fund fee for self-insured employers that obtain certification under this section within 90 days of the bill's effective date.
