Defendants charged with offenses must be allowed counsel at bail determination hearings, with courts appointing a public defender or licensed attorney if the defendant cannot obtain counsel.

Arrested persons must be taken without unnecessary delay before the nearest judge in their county (or nearest judge irrespective of county if in a regional jail authority) and a charge must be filed.

Judges may order confiscation of passports or impose travel restrictions on defendants arrested for first-degree murder or violent crimes if necessary to ensure appearance and compliance with release conditions.

Foreign nationals arrested or detained must be advised in open court of their right to have notice given to their country's consular representatives and to communicate with them, with a written record made of this advisement.

Courts must grant reasonable continuance requests to allow foreign national defendants to contact their consulate if consular notification was not provided before the first court appearance, with the trial period temporarily suspended during such delays.
