SB1731 Summary

• Amends the Renter's Financial Responsibility and Protection Act to make a technical change to Section 15 regarding prohibited practices in vehicle rental damage waivers.

• Requires written renter agreement to damage waivers at or prior to execution of the rental agreement.

• Limits rental companies to charging maximum of $12.50 per full or partial 24-hour day for collision damage waivers prior to January 1, 2014, and $13.50 per day beginning January 1, 2014.

• Allows rental companies to void damage waivers only for specific reasons including commercial use, racing, intentional damage, fraudulent contracts, off-continental use, unauthorized drivers, and DUI-related incidents.

• Exempts luxury vehicles with manufacturer's suggested retail price exceeding $50,000 from the damage waiver pricing limitations.
