SB1782 Summary

• State's Attorney shall petition circuit court for automatic expungement of arrests or charges for retail theft under $300, criminal trespass, traffic offenses (excluding fleeing/eluding and DUI), and Class 4 felony controlled substances violations that result in acquittal, dismissal, or conviction reversal.

• Circuit court must promptly enter an expungement order within 90 days upon filing of a State's Attorney petition under this provision.

• Expungement does not apply to offenses involving fleeing or attempting to elude a peace officer, aggravated fleeing/eluding, driving under the influence, or any offense resulting in bodily harm.

• Amends the Criminal Identification Act (20 ILCS 2630/5.2) to streamline the expungement process for eligible minor criminal charges through prosecutor-initiated petitions.
