SB1871 Summary

• Redefines "use as rolling stock moving in interstate commerce" for motor vehicles and trailers purchased on or after July 1, 2017 to require certification that vehicles will be utilized by interstate carriers holding active USDOT Numbers with "Interstate" operations and "authorized for hire" or "exempt for hire" classifications.

• Eliminates previous rolling stock exemption definitions based on percentage of trips or miles in interstate commerce for motor vehicles and trailers purchased on or after July 1, 2017, replacing them with USDOT certification requirements.

• Exempts motor vehicles and trailers used at airports to support aircraft operations from the USDOT certification requirement, as long as they meet other qualification criteria.

• Clarifies that property attached to motor vehicles or trailers purchased on or after July 1, 2017 must meet the new rolling stock definition, regardless of when the vehicle or trailer itself was purchased.

• Effective date is July 1, 2017.
