IL SB1977

Removes the phrase "in the custody or possession of" from the presumption that all records of a public body are open to inspection or copying.

Changes the definition of "public records" to include only records "prepared by or for the public body" and removes language covering records "having been or being used by, received by, in the possession of, or under the control of any public body."

Maintains that any public body asserting a record is exempt from disclosure must prove by clear and convincing evidence that it qualifies for an exemption.

Applies to amendments of the Freedom of Information Act sections 1.2 and 2 (5 ILCS 140).
