SB1980 Summary

• Expands non-bailable offenses to include unlawful use of weapons in schools, violations of firearm statutes near schools, and making terrorist threats when defendant poses real and present threat to physical safety.

• Adds new subsection (a-5) allowing State's Attorney to request source of bail hearing when bail is set for weapons offenses and related violations.

• Creates new bail condition (5.5) requiring surrender of all firearms and Firearm Owner's Identification Card for school-based weapons violations and certain prior forcible felony convictions.

• Adds new bail condition (6) requiring psychological evaluation for defendants charged with unlawful weapons use in schools, with court authority to order compliance with evaluation recommendations and restrict access to school property.

• Modifies firearm confiscation procedures to send Firearm Owner's Identification Cards to Department of State Police instead of Illinois State Police.
