SB2063 - Unbalanced Budget Response Act

• Creates the Unbalanced Budget Response Act to address Illinois' fiscal crisis during fiscal years 2017 and 2018, granting the Governor authority to establish contingency reserves from previously appropriated funds and transfer balances between special funds and the General Revenue Fund.

• Allows the Governor to designate contingency reserves from agency appropriations (excluding debt service, general State aid to schools, and early childhood education) and modify statutory fund transfers, with limits based on projected budget shortfalls.

• Permits the Governor to modify payment rates to service providers and delay payments under continuing appropriations (excluding debt service), with authority to pay delayed amounts from the next fiscal year's appropriation.

• Authorizes five specified state agencies (Aging, Children and Family Services, Healthcare and Family Services, Human Services, and Public Health) to adopt emergency rules without standard rulemaking procedures to implement budget reductions, rate adjustments, and eligibility changes as permitted by federal law.

• Repeals the act on July 1, 2018; amends the Illinois Administrative Procedure Act and Public Aid Code to support emergency rulemaking authority; and exempts the act from State Mandates Act reimbursement requirements.
