IL SB2074

Creates the Conviction History Reporting Act to regulate consumer reporting agencies that furnish criminal history reports.

Prohibits criminal history reports from including information more than 5 years old or any criminal history record information that is not a conviction.

Exempts discharged or dismissed orders of supervision or qualified probation from being classified as conviction information.

Allows subjects of violated reports to recover minimum damages of $1,000 per report (or actual damages if greater), court costs, reasonable attorney's fees, and punitive damages.

Does not apply to background information collected under the Illinois Uniform Conviction Information Act or information from publicly available registries.
