SB2178 - Budget Management and Control Act

• Allows the Governor to transfer up to $1 billion total from any State fund to the General Revenue Fund during fiscal years 2017-2019, with exceptions for federal trust funds, debt service, retirement systems, the Road Fund, and legislative/judicial branch funds.

• Authorizes the Governor to modify Medicaid (Title XIX and XXI) payment rates, benefits, and eligibility criteria to achieve up to 5% in program savings for fiscal year 2018 without standard rulemaking procedures.

• Adds new emergency rulemaking authority under the Illinois Administrative Procedure Act allowing agencies to adopt emergency rules to implement budget modifications without the standard 24-month limitation on emergency rules.

• Amends the Illinois Public Labor Relations Act to establish that health insurance plan design and administration are not subject to collective bargaining when employee premiums and out-of-pocket costs do not exceed 40% of total active employee healthcare costs, though premium contribution levels remain negotiable.

• Takes effect immediately upon becoming law and exempts the Act from State Mandates Act reimbursement requirements.
