SB2339 Summary

• Amends Section 4-103 of the Illinois Vehicle Code to clarify that knowledge a vehicle or essential part is stolen may be inferred from surrounding facts and circumstances or from exclusive unexplained possession, regardless of when the vehicle was stolen.

• Removes legislative finding language about vehicle acquisition and disposition being strictly controlled by law and reflected through documents of title, uniform invoices, rental contracts, leasing agreements, and bills of sale.

• Creates exception in Section 4-103(a-1) allowing vehicle repair persons to knowingly possess manufacturer's identification number plates for reaffixing on damaged vehicles, with requirements to notify Secretary of State and maintain records.

• Requires vehicle owners whose vehicles are repaired under the exception to contact the Illinois State Police Vehicle Inspection Bureau within 90 days to arrange inspection.

• Adds Section 5-408 to the Juvenile Court Act requiring minors detained for vehicular hijacking, aggravated vehicular hijacking, or stolen motor vehicle possession to be brought before a judicial officer within 40 hours for detention hearing, with presumption of immediate and urgent necessity and mandatory psychological evaluation.
