• Requires all state procurement scoring rubrics to allocate 20% of total available points toward evaluation of respondents' commitment to diversity, with 30% allocation for services/products with history of disparate awards.

• Scoring rubrics must evaluate diversity factors including: governance board composition, minority/women/disability ownership and management, percentage of diverse staff and executives, and use of diverse subcontractors.

• State agencies and public institutions of higher education must exempt contracts from diversity requirements if compliance would result in loss of federal-aid funds, grants, or loans.

• All employees of each Chief Procurement Officer must complete annual diversity and inclusion training, with reports submitted to the Business Enterprise Council and Executive Ethics Commission.

• Vendors failing to meet Business Enterprise Program spending goals are ineligible for contract renewal, except for construction and construction-related services contracts.
