SB2422 Summary

• Amends the Firearm Owners Identification Card Act to require a valid Firearm Owner's Identification Card (FOID) for acquiring or possessing pre-packaged explosive components in Illinois, with exemptions for military personnel, licensed manufacturers, and certain contractors.

• Defines "pre-packaged explosive components" as a pre-packaged product containing 2 or more unmixed, commercially manufactured chemical substances that when mixed result in an explosive material regulated by the federal Bureau of Alcohol, Tobacco, Firearms, and Explosives under 27 CFR Part 555.

• Creates a new criminal offense under Section 24-4.3 of the Criminal Code for unlawful sale or delivery of pre-packaged explosive components, making it a Class 4 felony when selling to disqualified persons, to persons without a valid FOID card, or when engaged in the business without federal firearms dealer licensing.

• Provides liability protection for sellers and transferors who comply with the requirements of the law, except in cases of willful or wanton misconduct.

• Takes effect July 1, 2018.
